Terms of Service

These Terms of Service ("Terms") govern your access to and use of Human Peak's personalized AI assistant service (the "Service"), operated by Human Peak ("Human Peak", "we", "us"), based in São Paulo, SP, Brazil. By using the Service you agree to be bound by these Terms.

1. About the Service

Human Peak provides personalized AI assistants accessible primarily through WhatsApp. Each customer receives a dedicated assistant that can, with explicit user consent, integrate with third-party services such as Google Workspace (Gmail, Calendar, Drive, Docs, Sheets) to help the user complete tasks.

2. Eligibility

You must be at least 18 years old and capable of entering into a binding contract to use the Service. You must have a valid WhatsApp account and, if you choose to use Google integrations, a valid Google account.

3. Account responsibility

You are responsible for maintaining the security of your WhatsApp account, your Google account and any other credentials used with the Service. You agree to notify us promptly at contato@humanpeak.ai of any unauthorized access or suspected security incident.

4. Acceptable use

You agree not to use the Service to:

• Engage in any illegal activity or violate any applicable law or regulation.
• Send spam, phishing messages, malware or otherwise abuse messaging platforms.
• Harass, threaten, defame or harm any person.
• Attempt to reverse engineer, decompile, hack, probe or otherwise interfere with the Service or its underlying infrastructure.
• Use the Service to generate or distribute content that infringes intellectual property rights or privacy rights of others.
• Circumvent rate limits, security controls or usage quotas.

We may suspend or terminate your access if we reasonably believe you are violating these rules.

5. Google services integration

By connecting your Google account, you authorize Human Peak to access only the data covered by the OAuth scopes you consent to, and only to perform tasks you explicitly request through your assistant. You can revoke this access at any time at https://myaccount.google.com/permissions. Our handling of Google user data is described in our Privacy Policy and complies with the Google API Services User Data Policy.

6. AI-generated content

The Service relies on AI models that may occasionally produce inaccurate, incomplete or misleading outputs. You are responsible for reviewing any AI-generated content before acting on it, sending it, or using it for decisions with legal, financial or safety consequences.

7. Payment terms

Pricing for the Service is communicated separately, either through a published price list or a written proposal. Fees, plans and limits may change with at least 30 days' prior notice. Taxes are your responsibility unless explicitly stated otherwise.

8. Intellectual property

Human Peak retains all rights, title and interest in and to the Service, including its software, design, models, prompts, infrastructure and documentation. You retain all rights to the content you provide and to the data in your connected accounts. You grant Human Peak a limited license to process that content solely to operate and provide the Service to you.

9. Limitation of liability

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, non-infringement or uninterrupted availability. To the maximum extent permitted by law, Human Peak shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data, goodwill or other intangible losses, arising out of or related to your use of the Service.

10. Termination

You may stop using the Service and request account deletion at any time by emailing contato@humanpeak.ai. We may suspend or terminate your access to the Service if you violate these Terms, if required by law, or if continued provision of the Service becomes impractical. Upon termination, your data will be deleted as described in the Privacy Policy.

11. Governing law and jurisdiction

These Terms are governed by the laws of the Federative Republic of Brazil. Any dispute arising out of or in connection with these Terms shall be submitted to the courts of the Judicial District of São Paulo, SP, Brazil, to the exclusion of any other forum, however privileged.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified to registered users by email at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
